Cette analyse illustre le statut particulier et spécifique de la victime d’acte de piraterie maritime. En mettant en exergue le lieu de commission de l’infraction, le lieu de poursuites et de jugement et le lieu de résidence des victimes, il y apparaît un déséquilibre fondamental concernant les sanctions qui diffèrent d’un Etat à l’autre et un décalage considérable quant aux réparations des préjudices d’une même importance. Il se présente dès lors la nécessité d’harmonisation des règles relatives aux sanctions des pirates et aux réparations des préjudices subis par les victimes.

This analysis illustrates the particular and specific status of the victim of act of maritime piracy. By highlighting the place where the crime was committed, the location of trials and the place of residence of the victims, it appears a fundamental imbalance concerning the penalties which differ from a State in the other one and the considerable gap as for the compensations for damages of the same importance. There is from then on a necessity of harmonization of rules relative to the penalties of the pirates and to the repairs of damages undergone by the victims.
